WHEREAS, in a Resolution
promulgated on March 27, 2006 and March 30, 2006, respectively, by
the Honorable Eighth Division, the Court granted
Petitioners-Appellants’(UBFHAI) application for a writ of
preliminary injunction, which reads:
“ACCORDINGLY, and as prayed for by
the Petitioners-Appellants(UBFHAI), let a writ of preliminary
injunction be issued, enjoining the City Mayor and the Sangguniang
Panglunsod of Parañaque, the Philippine National Police operatives,
and any or all persons claiming authority under them, from
enforcing or implementing Ordinance No. 00-15 (672), Series of 2000
(Opening of Gates, BF Homes Subdivision), until the final
disposition of this case. The clerk of Court of this Division is
hereby DIRECTED to cause the Immediate service of this Resolution to
all the parties through personal service.
SO ORDERED.”
“With the filing of
the cash bond in the amount of P100,000.00 by
Petitioners-Appellants (UBFHAI), the issuance of the writ of
preliminary injunction, per Resolution of the Court dated March 27,
2006, is now in order.”
NOW THEREFORE, YOU, THE HONORABLE
CITY MAYOR OF PARAÑAQUE, ITS SANGGUNIANG PANGLUNSOD AND THE
PHILIPPINE NATIONAL POLICE, AND ALL OTHER PERSONS ACTING FOR AND IN YOUR
BEHALF, ARE HEREBY RESTRAINED FROM ENFORCING THE ASSAILED ORDINANCE
NO. 00-15 (672), SERIES OF 2000.
